Terms & Conditions
1. Who may use the Service
Parent and guardian accounts are for adults (18 years or older) who have legal authority to enrol and supervise a child. By registering, you represent that you are at least 18 and that you are the parent, legal guardian, or authorised caregiver of any child whose profile you create.
Children use the Service only through a child profile you create. You are fully responsible for their use of the Service, including login credentials, PIN codes, and activity.
2. Acceptance without separate checkbox
When you create an account, complete a payment, or continue using the Service after these Terms are posted or updated, you accept these Terms. A notice on the sign-up form that “by creating an account you agree to our Terms & Conditions and Privacy Policy” is binding. You do not need to tick a separate box for acceptance to apply.
3. The Service (educational content only)
MIA Classroom provides digital educational materials (including lessons, exercises, notes, and progress tools) intended to support learning. The Service is not a school, exam board, tutoring guarantee, or substitute for formal schooling, professional teaching, or parental supervision.
- We do not guarantee any exam result, grade, placement, scholarship, or learning outcome.
- Content may contain errors, omissions, or regional differences. Curricula and exam formats change; you use content at your own risk.
- Free Chapter 1 (or any free portion) is a limited preview and may change or end at any time.
- Paid access unlocks additional content for a specific child profile as described at checkout, typically until the relevant exam period as we define it — subject to these Terms.
4. Parental monitoring and supervision (required)
You agree to actively monitor and supervise your child’s use of MIA Classroom at all times. You are solely responsible for their online safety, screen time, device security, and how they interpret or apply any content.
You acknowledge that:
- We do not provide real-time supervision of children;
- We are not responsible for any harm, distress, academic setback, device damage, or other consequence arising from a child’s use of the Service;
- You must keep student codes, PINs, and account credentials confidential and change them if compromised;
- You will ensure the Service is used in a suitable learning environment and for lawful educational purposes only.
5. Accounts and acceptable use
You must provide accurate registration information and keep it updated. You may not:
- Share, sell, rent, or transfer your account, child profiles, or paid access;
- Copy, scrape, download in bulk, reverse engineer, or redistribute Service content;
- Circumvent paywalls, access controls, or security features;
- Upload malware, harass others, or use the Service for anything illegal or harmful;
- Misrepresent your identity, age, or relationship to a child;
- Use bots, automated scripts, or unauthorised third-party tools to interact with the Service.
We may suspend or terminate accounts, revoke access, or refuse service at our sole discretion if we believe these Terms have been violated or if continued use poses risk to us or others — without refund.
6. Fees, payments, and ALL SALES FINAL
No refunds. All payments for MIA Classroom are final and non-refundable. This includes one-time unlocks, sale prices, promotional pricing, and any other fees. By paying, you expressly waive any right to a refund, chargeback, or credit to the maximum extent permitted by law.
- Prices are shown in local currency where available and may change at any time before you pay.
- Payments are processed by third-party providers (including WiPay). Their terms also apply. We are not liable for gateway outages, failed payments, bank delays, or card issuer decisions.
- Paid access is per child profile as stated at checkout. It is not transferable between children or accounts.
- If you initiate a chargeback or payment dispute after receiving access, we may immediately suspend the account and pursue recovery of fees, costs, and damages.
- Because digital content is delivered (or made available) immediately upon successful payment, you acknowledge that statutory cooling-off / withdrawal rights for distance selling — where they exist — may not apply once access is granted, to the fullest extent allowed by applicable law.
7. Intellectual property
All content, software, design, logos, text, graphics, lesson materials, and trademarks associated with the Service are owned by Inspire Made By Sudarshan Limited or its licensors. “MIA Classroom” and related branding are used as product/service names of the Company. Nothing in these Terms transfers ownership to you.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access the Service for private educational use by your household’s enrolled child profiles, solely while your access remains active and in accordance with these Terms. You may not republish, commercialise, or create derivative works from our content without prior written consent from the Company.
8. Third-party services
The Service may rely on third parties (hosting, analytics, payment processors, messaging tools). We are not responsible for third-party websites, apps, outages, data practices, or errors. Your use of third-party services is at your own risk and subject to their terms.
9. Disclaimers — AS IS / AS AVAILABLE
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
We do not warrant that the Service will be error-free, secure, or continuously available, or that content is complete, current, or suitable for your child’s specific exam, school, or learning needs.
10. Limitation of liability — we take no fall
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSPIRE MADE BY SUDARSHAN LIMITED, ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, EDUCATIONAL OPPORTUNITY, OR EXAM OUTCOME, ARISING FROM OR RELATED TO THE SERVICE — WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE — EVEN IF ADVISED OF THE POSSIBILITY.
Without limiting the above, we are not liable for:
- Any academic result or lack of improvement;
- Any error or omission in educational content;
- Any injury, emotional distress, or conflict arising from study use or parental disputes;
- Unauthorised access resulting from weak passwords, shared PINs, or unsecured devices;
- Service interruptions, data loss, or force majeure events.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE LESSER OF (A) THE AMOUNT YOU PAID TO US FOR THE SPECIFIC CHILD ACCESS GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $20 (OR LOCAL EQUIVALENT). IF YOU HAVE PAID NOTHING, OUR LIABILITY IS ZERO.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes liability that cannot legally be excluded (for example, fraud by us, where applicable).
11. Indemnity
You agree to indemnify, defend, and hold harmless Inspire Made By Sudarshan Limited and its directors, officers, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your or your child’s use of the Service; (b) your breach of these Terms; (c) your failure to supervise a child; (d) any content or data you submit; or (e) any dispute between you and a third party (including another parent or school).
12. Privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms by reference.
13. Changes to the Service or Terms
We may modify, suspend, or discontinue any part of the Service at any time without liability. We may update these Terms by posting a revised version on this page with a new “Last updated” date. Continued use after changes means you accept the updated Terms. If you do not agree, stop using the Service.
14. Termination
You may stop using the Service at any time. We may terminate or restrict access immediately, with or without notice, for any reason including breach of these Terms. Upon termination, your licence ends. Sections that by nature should survive (including payments/no-refund, IP, disclaimers, liability limits, indemnity, and governing law) survive termination. No refunds are due on termination.
15. Governing law and disputes
These Terms are governed by the laws of Trinidad and Tobago, without regard to conflict-of-law rules. You agree that the courts of Trinidad and Tobago have exclusive jurisdiction over disputes arising from these Terms or the Service, except that we may seek injunctive or other relief in any jurisdiction to protect our intellectual property or prevent misuse.
Before filing a claim, you agree to contact us at hello@miaclassroom.com and attempt good-faith resolution for at least thirty (30) days.
16. General
- If any provision is held unenforceable, the rest remains in effect.
- Our failure to enforce a provision is not a waiver.
- These Terms are the entire agreement between you and the Company regarding the Service and supersede prior understandings on that subject.
- You may not assign these Terms; we may assign them in connection with a reorganisation, sale, or similar transaction.
- Headings are for convenience only.
